New WA Mining Proposal Requirements - are you ready?

The Department of Mines, Industry Regulation and Safety’s (DMIRS) recent update to the 2016 Guidelines for Mining Proposal and Mine Closure Plans has potentially significant implications for mining companies.

Companies previously had six years (up to 01 January 2023) to transition from the 2006 Guideline to the 2016 Guidelines. The updated Guidelines has now removed this clause and requires all new Mining Proposals to be in alignment with the updated 2016 Guidelines.

So what does this mean?

With the updated Guidelines expected to be published in February 2020, this means all new Mining Proposals submitted must conform to the updated 2016 Guidelines format, which is structured to cover the whole of mine site, and works on a more risk-based assessment and outcomes approach. 

As a concession, DMIRS will allow Mining Proposals for individual components of a mine site to be submitted in the updated 2016 Guideline format. However, DMIRS recommend that proponents move to the whole of site 2016 Guidelines where possible to avoid different outcomes across sites.
