Western Australia’s planning system is set for a once-in-a-lifetime reform. This initiative to boost the State’s economy, creates desirable business conditions for clients with projects deemed “significant”.

Under the reforms to the Planning and Development Act 2005 and Development (Local Planning Scheme) Regulations 2015, the Western Australian Planning Commission (WAPC) will for the short-term be the decision maker for all development proposals of State significance. This includes:

  • proposals with an estimated cost of $30 million or more
  • residential dwelling proposals with 100 or more dwellings
  • commercial developments with a minimum of 20,000sqm commercial floor space

Regional or tourism projects that may not meet the above criteria but are considered important to our economic recovery will also be included.

A major element to the reforms includes the streamlining of the environmental assessment process. For town planning schemes and amendments, the WAPC will engage the Environmental Protection Authority (EPA).

Of significance to our clients is the EPA and Department of Planning, Lands and Heritage determining which planning proposals require environmental assessment. Currently more than 90% of schemes and amendments referred to the EPA do not require assessment and opportunities exist to streamline the referral and project consideration process.
